Terms & Conditions
These terms and conditions apply to photography sessions and products supplied by Kaaron McKinnon Photography.
Please read them carefully before booking. If you have any questions, please contact me before paying your booking fee.
Booking Your Session
A £40 booking fee is required to reserve your session date and time. Your booking is not confirmed until the booking fee has been received.
The booking fee will be deducted from the total cost of your chosen package. The remaining balance is due in full on the day of your photoshoot, unless otherwise agreed in writing.
By paying the booking fee, you confirm that you have read and accepted these terms and conditions.
Cancellations and Rescheduling
If you need to cancel or reschedule your session, please give me as much notice as possible.
Wherever possible, I will work with you to arrange a suitable alternative date. Newborn sessions are naturally dependent on when your baby arrives, so session dates can be adjusted if your baby arrives earlier or later than expected.
Sessions may also be rescheduled in the event of illness, a family emergency or other exceptional circumstances.
If you decide to cancel your session rather than reschedule, any payments you have made will be refunded.
If I need to cancel your session, I will offer you an alternative date. If we cannot agree on a suitable alternative, all payments made will be refunded in full.
Your Right to Cancel
If your booking is made online, by email or by telephone, you may have a legal right to cancel the contract within 14 days of the date on which it was made.
If your photoshoot is due to take place within this 14-day period, you may be asked to confirm that you would like the service to begin before the cancellation period has ended.
Nothing in these terms and conditions affects your statutory rights.
Late Arrival
Sessions begin at the agreed time. If you arrive late, it may be necessary to shorten the session so that later appointments are not affected.
If you are more than 30 minutes late and there is insufficient time to complete the session safely or to the expected standard, the session may need to be rescheduled.
Please contact me as soon as possible if you expect to be delayed.
Illness
Please contact me before attending if you, your baby or anyone accompanying you is unwell or has recently experienced symptoms of an infectious illness.
I reserve the right to postpone a session if continuing would present a risk to the baby, the client, accompanying family members or the photographer.
Where illness affects either the client or the photographer, every effort will be made to arrange a suitable alternative date.
Newborn Sessions
The safety and comfort of your baby will always come first. I will never place a baby in a pose or position that I consider unsafe or unsuitable.
Please tell me before the session about any medical condition, additional need or recent treatment that may affect your baby’s comfort or safety during the photoshoot.
Newborn sessions are baby-led, and time will be allowed for feeding, changing and comforting your baby. Every baby is different, and particular poses or photographs cannot be guaranteed.
Parent and Sibling Photographs
Please let me know before your newborn session if you would like parent, family or sibling photographs included.
The studio is kept very warm for the baby and has limited space for entertaining young children. Where possible, I recommend that young siblings attend for either the first or final part of the session and are accompanied elsewhere by another responsible adult for the remainder.
Neutral clothing without large logos, prominent patterns or slogans is recommended for family photographs.
Parents and guardians remain responsible for supervising their children throughout the session and must follow any reasonable studio safety instructions.
Client Cooperation
Please provide any relevant information before your session, including the names and ages of participating children and any requirements that may affect the session.
While every effort will be made to create a varied gallery, the final results depend partly on the cooperation, mood and willingness of those being photographed.
I cannot guarantee a particular pose, expression, photograph or number of images. If a baby or child becomes unsettled or does not wish to participate, I will adapt the session wherever reasonably possible.
Photography Style and Artistic Discretion
By booking a session, you acknowledge that you are familiar with the photographic and editing style of Kaaron McKinnon Photography.
I will use my professional judgement when selecting the lighting, styling, poses, props, composition and final images included in your gallery.
Not every photograph taken during the session will be edited or supplied. Images that are duplicates, test shots, out of focus, poorly exposed or otherwise unsuitable will be removed during the selection process.
Unedited or RAW files are not supplied.
Cameras and Recording
Clients and accompanying guests may take photographs or short video clips during the session, provided that this does not interrupt the session, distract the baby or child, interfere with my equipment or compromise anyone’s safety or privacy.
Please ask before using flash, moving around the studio or recording any behind-the-scenes content.
Any photographs or videos taken must be for personal use only. They must not be sold, used commercially or shared in a way that identifies or includes another client, child or family without the appropriate permission.
I may change this policy in the future. Any updated policy will apply to bookings made after the updated terms have been published or otherwise provided to clients.
Viewing and Downloading Your Gallery
Your completed gallery will normally be ready within two weeks of your session. I will contact you as soon as it is available and provide a link to your private, password-protected online gallery.
Your gallery will remain available for 14 days. During this period, you can view and download the digital images included in your chosen package directly to your computer or device.
Purchased digital images will be supplied in high resolution and may be printed for personal use.
Please download all your images before the gallery expires and save them in more than one secure location. A £15 reactivation fee may apply if you ask for an expired gallery to be reopened.
Additional Images and Products
Depending on your chosen package, you may have the option to purchase additional digital images, prints, albums, wall art or other products after viewing your gallery.
All orders must be paid for in full before they are processed.
Physical products will normally be available for collection within approximately two weeks of cleared payment. This timeframe may vary depending on the product and the supplier. I will let you know if an order is expected to take longer.
Colours and brightness can vary slightly between screens and printed products. I cannot guarantee that prints produced by third-party or high-street printers will match the colours or quality of professionally supplied products.
Personalised Products and Cancellation
Albums, frames, prints, wall art and other products made to your personal specifications cannot normally be cancelled or returned simply because you have changed your mind once the order has been placed with the supplier.
This does not affect your legal rights if an item is faulty, damaged, incorrectly supplied, not as described or not of satisfactory quality.
Please check image choices, sizes, colours, layouts, spellings and other details carefully before approving a product order. Once approval has been given, I cannot accept responsibility for information or choices supplied incorrectly by the client.
Receipt of Products
Please inspect all portraits, albums, frames, wall art and other products when you receive them.
If an item appears damaged, faulty or incorrectly supplied, please notify Kaaron McKinnon Photography in writing as soon as reasonably possible and include photographs of the problem where appropriate.
Incorrectly supplied or faulty products will be repaired, replaced or otherwise resolved in accordance with your statutory rights.
Once products have been received in good condition, the client is responsible for their safe handling, storage and care.
Image Storage and Backups
Completed gallery images are normally retained for up to one year after the gallery closes. However, permanent or indefinite storage cannot be guaranteed.
Clients are responsible for downloading their purchased images promptly and keeping secure backup copies.
Kaaron McKinnon Photography is not responsible for replacing images that are lost by the client or for maintaining images indefinitely after the stated storage period.
Copyright and Personal-Use Licence
Copyright in all photographs remains with Kaaron McKinnon Photography in accordance with UK copyright law.
When high-resolution digital images are included in or purchased as part of your package, you are granted a licence to:
Download and store the images.
Make prints for personal use.
Share the images with friends and family.
Share the images on your personal social-media accounts.
Images must not be sold, entered into commercial arrangements, supplied to another business for promotional use or used to make a financial gain without prior written permission.
Please do not significantly alter the images, apply filters, remove watermarks or present altered versions as the photographer’s finished work.
Copyright is not transferred to the client when digital images or physical products are purchased.
Permission to Use Images
Your privacy is important, and agreeing to the public use of your photographs is not a condition of booking.
Your booking form will give you the opportunity to indicate whether you give permission for images from your session to be used by Kaaron McKinnon Photography. This may include use on the business website, social-media pages, portfolio displays, printed marketing materials, photography competitions or promotional materials.
Where children are included, the person providing permission confirms that they have parental responsibility or appropriate authority to provide that permission.
If you do not give permission, your images will remain private and this will not affect the service you receive.
If you initially give permission and later change your mind, please contact me in writing. I will stop future use and take reasonable steps to remove the images from online platforms under my control. It may not be possible to recover printed materials already produced or images previously shared or published.
Privacy and Personal Information
Personal information and photographs will be handled in accordance with applicable data-protection law and the Kaaron McKinnon Photography Privacy Policy.
Information supplied in connection with your booking will be used to administer and provide your photography service, communicate with you, process payments and orders, maintain appropriate business records and fulfil relevant legal obligations.
Private gallery links and passwords should not be shared publicly.
Responsibility and Safety
Kaaron McKinnon Photography will take reasonable care to maintain a safe studio environment.
Clients are responsible for supervising their children and personal belongings during the session and for following reasonable safety instructions.
Kaaron McKinnon Photography cannot accept responsibility for loss or damage arising from a client’s failure to follow safety instructions or properly supervise a child.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
Events Outside Our Control
Neither the client nor Kaaron McKinnon Photography will be responsible for failing to perform an obligation where this is caused by circumstances genuinely outside their reasonable control.
This may include serious illness, family emergencies, severe weather, travel disruption, power failure, equipment failure or the closure or inaccessibility of the studio.
Where possible, the session will be rescheduled. If an alternative date cannot be agreed, payments for services or products not provided will be refunded.
Concerns and Complaints
If you are unhappy with any aspect of your experience, please contact me as soon as possible so that I have an opportunity to understand and resolve the issue.

Governing Law
These terms and conditions are governed by the laws of Scotland. Any dispute will be subject to the jurisdiction of the Scottish courts.
Nothing in these terms and conditions affects the client’s statutory consumer rights.
